Terms of Service - Living Air Inc.

Effective Date: February 18, 2026

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”) and Living Air Inc. (“Company,” “we,” “our,” or “us”) governing all HVAC services, maintenance plans, financing arrangements, and website use.

By requesting service, signing an estimate, approving financing, or using our website, you agree to these Terms.

1. Scope of Services

Living Air Inc. provides residential and commercial HVAC services including but not limited to:

Air conditioning installation and replacement
HVAC system repairs
Preventative maintenance
Heating system services
Indoor air quality products
Emergency service

All work is subject to inspection and written approval.

We reserve the right to refuse service at our discretion.

2. Estimates & Change Orders

All estimates are based on visible and accessible conditions at the time of inspection.
Hidden damage, code violations, structural issues, electrical deficiencies, or unforeseen conditions may require additional charges.
No additional work will be performed without Customer approval.
Verbal approvals are binding.

3. Payment Terms

Payment is due immediately upon completion unless otherwise agreed in writing.

We reserve the right to:

Charge late fees on overdue balances
Suspend warranties for unpaid invoices
File liens as permitted under Florida law

Customer agrees to pay all collection costs, including attorney’s fees, if payment is not made.

4. Financing Disclosure

Living Air Inc. may offer financing through third-party providers including Ygrene.

We:

Do not control financing decisions
Do not determine interest rates
Are not responsible for financing approval or denial
Are not liable for disputes between Customer and financing provider

Customer acknowledges they are entering into a separate agreement with the financing company.

5. Service Contract Disclaimer

Any service contract, extended warranty, or maintenance agreement is governed by its own written terms.

Living Air Inc. does not guarantee:

Continuous system operation
Prevention of all breakdowns
Utility cost savings
Equipment lifespan beyond manufacturer specifications

Service contracts do not constitute insurance policies.

We are not responsible for:

Pre-existing system defects
Improper prior installations
Manufacturer defects
Acts of God, storms, flooding, or power surges

6. Maintenance Requirements & Warranty Conditions

Manufacturer warranties and labor warranties may require:

Proper registration
Regular documented maintenance
Timely filter changes

Failure to maintain equipment may void warranties.

Living Air Inc. is not responsible for manufacturer warranty denials.

7. Limitation of Liability

To the fullest extent permitted by Florida law:

We are not liable for indirect, incidental, special, or consequential damages.
Our total liability shall not exceed the amount paid for the specific service provided.
We are not responsible for property damage resulting from pre-existing structural, electrical, plumbing, or roofing deficiencies.

Customer agrees to hold Living Air Inc. harmless from claims arising from misuse, neglect, or unauthorized modifications.

8. Permits & Code Compliance

Where required, permits will be obtained.

Customer is responsible for:

HOA approvals
Providing safe access
Ensuring utilities are operational

We are not responsible for delays caused by inspection scheduling or municipal processes.

9. Cancellation Policy

Same-day cancellations may incur a service charge.
Special-order equipment may not be refundable.
Deposits on custom equipment are non-refundable.

10. Governing Law & Venue

These Terms are governed by Florida law.

Any disputes shall be resolved exclusively in Miami-Dade County, Florida.
